Distance Selling Contract

This text is the general contract framework. A dynamic distance selling contract is created for each order, containing the actual seller, buyer, product, price and delivery information; The order-specific contract is taken as basis.
Article 1 - Parties
Seller: It is the product seller whose information is shown on the order screen and in the contract.
Buyer: It is the consumer or user who placed the order.

Article 2 - Subject
The subject of the contract is the sale, delivery, payment, withdrawal, return and determination of the rights and obligations of the parties of the goods or services ordered by the buyer electronically.
Article 3 - Product and price
Basic features of the product, quantity, sales price, taxes, shipping and total order amount. It is shown in the summary and in the contract. Mandatory expenses that are not shown before payment confirmation cannot be requested later.
Article 4 - Establishment of the contract
An electronic order is created when the buyer approves the preliminary information and presses the order button that creates the payment obligation. Payment verification, stock or security control may be required.
Article 5 - Delivery
The seller delivers the product within the method and time specified in the contract. Legal maximum performance periods are reserved. The buyer is responsible for the accuracy of the delivery address.
Article 6 - Right of withdrawal
Except for legal exceptions, the consumer may withdraw within 14 days from the delivery of the goods without giving justification and without paying any penalty. It is sufficient to send the notice of withdrawal to the seller or to the channel offered by the platform within the period.
Article 7 - Return
After the notice of withdrawal, the buyer sends the product to the real seller's return address, within the period and method specified in the legislation.Loss of value arising from the use of the product beyond normal examination can be evaluated according to the concrete event.
Article 8 - Exceptions for withdrawal
There may be no right of withdrawal in products that are personalized, perishable, have hygiene protection opened, are mixed in such a way that they cannot be separated after delivery, and other contracts listed in the legislation. Exceptions specific to the order are explained before payment.
Article 9 - Refund
In case of valid withdrawal or cancellation, payments are refunded in accordance with the period and method in the legislation and, as a rule, in accordance with the payment instrument used. The bank's reflection period may also be applied.
Article 10 - Defective goods
In case the product does not comply with the contract, the consumer's optional rights arising from the current consumer legislation are reserved.
Article 11 - The role of the platform
The platform provides technical intermediation and support in third-party seller transactions. This does not eliminate the sales and performance obligations of the independent seller, without prejudice to the responsibilities imposed on the platform by the legislation.
Article 12 - Force Majeure
In cases of natural disaster, war, epidemic, official decision, transportation interruption, cyber attack or events beyond the reasonable control of the parties, obligations may be postponed to the extent of the impact of the event. The consumer's mandatory rights are reserved.
Article 13 - Dispute
The consumer may apply to the Consumer Arbitration Committee or the Consumer Court according to the current monetary limits. Turkish law is applied and the consumer's mandatory jurisdiction rights are protected.
Article 14 - Enforcement
The order-specific contract comes into force when it is approved electronically and can be transmitted to the parties via a permanent data recorder.
