Seller Membership and Marketplace Agreement

This text is the agreement between the seller and Aydın Kayydın Private Business for allbazaardan.com marketplace services. It is the general contractual framework for its use. The current contract and its annexes approved by the seller panel are binding.
1. Parties and subject of the contract
Platform operator Aydın Kaydin Private Enterprise; It provides store, product listing, ordering, payment integration, notification and support infrastructure to the seller. The seller offers his products for sale in his own name and account and becomes the seller party to the sales contract.
2. Seller statements
Seller; declares that he is authorized to engage in commercial activity, that the information he provides is correct, that he is authorized to sell the products, and that his activity complies with tax, consumer, product safety, intellectual property and other legislation.
3. Product and content obligations
Seller; Keeps product name, description, image, price, stock, tax, delivery, warranty and return information accurate. It cannot list products that pose a health or safety risk, are counterfeit, illegal, prohibited or infringement of rights.
4. Order and execution
The seller follows the order from the panel, prevents stock and price errors, prepares the order within the promised time, issues the invoice and delivers it to the appropriate carrier. Arbitrary cancellation, fake tracking number or off-platform payment redirection cannot be made.
5. Consumer rights
The seller complies with the obligations of preliminary information, distance selling, withdrawal, return, defective goods, warranty, service and complaint. The technical mediation of the platform does not remove the legal liability of the seller.
6. Fee, commission and offset
The seller pays the commission and service fees explained in the contract and panel. Amounts arising from returns, payment objections, consumer compensation, cargo or breach of contract can be deducted from the seller's receivables in accordance with the law and the contract.
7. Payment and interim measures
Seller payments are made according to the status of the order, delivery, return period, risk control and payment institution records.In case of fraud, intense complaints, counterfeit products, legal measures or payment objections, temporary payment measures in accordance with the legislation and the contract may be applied.
8. Data and privacy
The Seller cannot use customer data transferred to it solely for the purpose of order fulfillment for other than this purpose; cannot send messages without marketing consent; stores data securely and deletes or anonymizes it at the end of its expiration date.
9. Audit and sanctions
The platform may impose product removal, visibility reduction, order restriction, document request, payment measure, temporary suspension or termination. Decisions are notified to the seller with justification to the extent applicable.
10. Termination and its consequences
The parties may terminate the membership under the conditions specified in the contract. Dissolution; It does not eliminate previous orders, returns, customer demands, debts, data retention and legal responsibilities.
11. Dispute
Turkish law applies in disputes. Mandatory authorization rules in consumer transactions are reserved. Commercial disputes between the seller and the platform are subject to the jurisdictional provisions in the current contract.
