The document can be presented in writing or with a permanent data recorder.

The warranty certificate presented electronically means that the consumer accepts the document. It should be provided in a way that can be saved and accessed later without changing.

    7. Invoice does not replace the warranty certificate

Invoice, e-archive invoice, sales receipt and order summary can be used to prove the purchase.

However, for products that must be sold with a warranty certificate in Turkey, the invoice or receipt does not replace the warranty certificate. The real seller remains obliged to submit the warranty certificate separately.

In case the invoice or warranty certificate is lost, order, payment, delivery, serial number and platform records can be used to evaluate the request.

    8. Warranty period

For goods that must be sold with a warranty certificate in Turkey, the warranty period begins on the date the product is delivered to the consumer.

The general minimum warranty period is two years. For some goods, duration may be determined with units of measurement specified in the annex of the Regulation, such as kilometers or working hours. The period during which the product is repaired under warranty is added to the warranty period.

    • international cargo and customs process

may vary depending on the product.

If the term "international warranty" is used, it should be clearly stated in which countries, for which services and under what conditions the warranty is valid.

The fact that the warranty service is limited to a certain region does not eliminate the inalienable consumer rights of the buyer in the country of residence or delivery.

    10. Proof of the beginning of the warranty period

The following records can be used to determine the beginning of the warranty period:

    • delivery date,

    • replacement with a similar product without defects,

    • price reduction,

    • rescinding the contract and the price. Which of the refund options is requested is recorded separately in the system.

Indicating the right preferred by the consumer in the service delivery document is important in order to prove the request later.

    15. Service delivery document

When the product is hand-delivered to the authorized service station or received by the service, a document showing that the product has been received must be issued.

The document issuance procedure may be different for products sent by courier and in cases where the repair is carried out at the location of the product.

The delivery document should include the following, as much as possible:

    16. Maximum repair period

The maximum repair period may vary depending on the product category.

For the products annexed to the After-Sales Services Regulation, the maximum repair period determined specifically for the product is applied. For this reason, a single repair period is not accepted for all products.

The consumer is given the opportunity to follow up on:

    • date of acceptance of the product for service,

    • start of the inspection,

    • part waiting status,

    • date of completion of the repair,

    18. Malfunction of the product again

If the product malfunctions again within the warranty period after free repair, the conditions for the consumer to switch to other optional rights are evaluated.

The seller or service cannot force the consumer to repair an unlimited number of times.

    Whether the malfunction:

    • is the same malfunction,

    • its relationship with the previous repair,

    • whether it affects the use of the product.

    • the quality of the product,

    • the conditions in the warranty certificate and the legislation

    are examined together.

    19. Repair not possible

If it is claimed that the product cannot be repaired, this should be determined by a technical and justified report.

    Only:

    • the part cannot be found,

    • the product is old,

    • the service does not want to repair,

    • the repair cost is high Abstract statements such as:Usage error

    • liquid contact,

    • wrong voltage,

    • faulty electricity. connection,

    • inappropriate consumables,

    • exceeding capacity limits,

    • maintenance contrary to the manual,

    • use contrary to safety instructions,

    • unauthorized intervention causing malfunction.

The presence of one of these examples does not automatically mean that the malfunction will be considered a usage error. A technical connection must be established between the alleged use and the malfunction that occurred.

    21. Usage error report

If it is claimed that there is a usage error, this situation should be determined by:

    • authorized service station,

    • in case there is no authorized service, the seller, importer or manufacturer

by the seller, importer or manufacturer in the order stipulated in the legislation, within the maximum repair period for the product.

A copy of the report should be given to the consumer. It is mandatory.

To the extent possible, the report should include:

    • the service or expert who performed the inspection,

    • request a re-examination,

    • apply to the manufacturer or importer,

    • submit an independent technical report,

    • consumer arbitrator can apply to the board,

    • mandatory mediation,

    • consumer court

    .

The service report alone does not eliminate the consumer's legal remedies.

    23. Products requiring installation

On the product page and in the product documentation, to the extent applicable:

    • obligation for authorized installation,

If the seller or manufacturer stipulates that the installation should be carried out by authorized persons, this condition should be clearly stated before the purchasing decision.

    24. Assembly and installation errors

In case the installation is carried out by the seller or under the responsibility of the seller, faulty installation may constitute a violation of the contract.

In cases where the installation is intended to be carried out by the consumer, if faulty installation occurs due to a deficiency or mistake in the assembly instructions, the product may still be deemed to be in violation of the contract.

For this reason, not every installation problem is automatically considered a user error.

    25.Unauthorized intervention and repair

Unauthorized intervention on the product may affect the warranty coverage if it is technically proven that the malfunction is directly caused by this intervention.

    However:

    • damage to the protective label alone,

    • inspection of the product by a different service,

    • intervention on an unrelated part

in any case, the whole It does not mean that legal rights have ended.

The connection between the intervention and the malfunction is evaluated within the scope of the concrete event.

    26. Products that require periodic maintenance

    • maintenance intervals,

    • who will perform the maintenance,

    27. After-sales service and lifespan

For some products, manufacturers or importers may be obliged to provide maintenance, repair and spare parts services throughout the lifespan specified in the legislation.

The lifespan is not the same as the warranty period. After the warranty period expires, it may be necessary to provide paid maintenance, repair and spare parts services throughout the life of the product.

If damage occurs due to not providing after-sales services throughout its life, the consumer can apply for relevant dispute resolution methods by proving the damage.

    28. Verification of authorized services

In Turkey, authorized service information can be checked from the documents supplied with the product, through the official channels of the manufacturer or importer, and through the service information system of the Ministry of Commerce.

Users are advised to be careful about people and businesses that introduce themselves as "authorized services" but whose authority cannot be verified.

Independent services, promotions that may mislead the user even though they are not authorized services. should not.

    29.Paid repair

    • fault detection,

    • estimated fee,

    • part cost,

    • labor cost,

    • estimated period,

    • consumer approval

    must be obtained.

It is essential that non-essential additional repairs or parts replacement are not carried out without the consumer's approval.

In case the paid repair service is incomplete or faulty, the consumer may assert his rights regarding the defective service against the service provider.

    30. Replaced parts

In case of part replacement during the repair, in the service record:

    • replaced part,

    • whether the operation is under warranty,

    • part fee,

    • labor,

    • replacement of the old part. status

Whether the replaced old part will be delivered or not is determined according to product safety, warranty and environmental legislation and service practice.

    31. Warranty period of the replaced product

In case the product is replaced with a new one within the scope of the warranty application, the warranty period of the replaced product in terms of compulsory warranty in Turkey is, as a rule, limited to the remaining warranty period of the first purchased product.

The seller, manufacturer or importer may undertake a new, longer warranty period.

    32.Devices containing data

Before a phone, computer, tablet, smart watch, camera, security device or any other product that stores data is sent to service, the user must:

    • back up his data,

    • log out of personal accounts,

    • remove personal data if possible,

    • operation contrary to the instructions for use,

    • external impact,

    • liquid or chemical contact,

    • inappropriate electrical infrastructure,

    • wrong assembly,

    • unauthorized intervention causing malfunction,

    • natural wear,

    • inappropriate consumables supplied by the consumer,

    • failure to perform the maintenance declared by the manufacturer.

General statements such as “out of warranty” are not sufficient. The decision must be based on the product, malfunction and technical findings.

Out-of-warranty evaluation does not mean that other legal rights unrelated to the malfunction are automatically eliminated.

    36. Consumables and natural wear

The warranty coverage of batteries, filters, gaskets, cartridges, bulbs, tires or similar parts that wear out naturally during use may vary depending on the product and warranty conditions.

However, if a part is a consumable:

    • serial number and authorization information. may examine,

    • take measures on the seller's account,

    • cooperate with the necessary authorities.

Failure to access warranty service for a counterfeit or illegal product does not eliminate the consumer's refund, exchange, compensation and other legal rights against the real seller.

    39. Recall and product safety

In case of a safety risk or recall decision about the product:

    • the product should not be used,

    • relevant safety instructions should be followed,

    • the seller, manufacturer or importer should be contacted,

    • notification should be made to the platform,

    • the return, repair, replacement or recall process should be followed.

The expiration of the warranty period does not prevent the implementation of product safety and official recall measures.

    40. If the manufacturer or importer terminates its activities

In case the importer terminates its commercial activities in Turkey, the seller, the manufacturer and the new importer may be jointly responsible for providing maintenance and repair services during the warranty period, when the conditions are met.
